คำนิยาม
“บริการ” หมายถึง เว็บไซต์และเครื่องมือสร้างภาพนางแบบ/นายแบบด้วยปัญญาประดิษฐ์ (AI) ที่ให้บริการโดย LOOX
“โมเดล AI” หมายถึง ภาพบุคคลที่สร้างขึ้นด้วยระบบปัญญาประดิษฐ์ ไม่ใช่ภาพถ่ายของบุคคลจริง เว้นแต่จะระบุไว้เป็นอย่างอื่น
“ผู้ใช้บริการ” หมายถึง บุคคลหรือนิติบุคคลที่สมัครใช้งานหรือเข้าถึงบริการ
“เนื้อหาที่สร้างขึ้น” หมายถึง ภาพ วิดีโอ หรือไฟล์ผลลัพธ์ใด ๆ ที่เกิดจากการใช้บริการ
การยอมรับข้อกำหนด
การเข้าใช้งานหรือสมัครสมาชิกถือว่าท่านได้อ่าน เข้าใจ และตกลงผูกพันตามข้อกำหนดฉบับนี้ และนโยบายความเป็นส่วนตัวที่แนบท้าย หากไม่ยอมรับ กรุณางดใช้บริการ
ผู้ใช้บริการต้องมีอายุ 20 ปีบริบูรณ์ขึ้นไป หรือบรรลุนิติภาวะตามกฎหมายของประเทศที่ผู้ใช้พำนักอยู่ และมีความสามารถทำนิติกรรมได้ตามกฎหมาย
ลักษณะของบริการ
บริการนี้ให้ผู้ใช้สร้างภาพนางแบบ/นายแบบเสมือน (virtual model) ผ่านระบบ AI เพื่อนำไปใช้ประกอบสื่อโฆษณา ภาพสินค้า หรือวัตถุประสงค์ทางการตลาดอื่น ๆ โดยภาพที่ได้เป็นผลงานที่สร้างขึ้นจากอัลกอริทึม มิใช่ภาพถ่ายของบุคคลจริง เว้นแต่กรณีที่ระบุไว้เฉพาะ
LOOX สงวนสิทธิ์ในการปรับปรุง เปลี่ยนแปลง หรือยกเลิกฟีเจอร์ใด ๆ ของบริการได้ตลอดเวลาโดยจะแจ้งให้ทราบล่วงหน้าตามความเหมาะสม
บัญชีผู้ใช้
ผู้ใช้ต้องให้ข้อมูลที่ถูกต้อง เป็นจริง และเป็นปัจจุบันในการสมัครสมาชิก
ผู้ใช้มีหน้าที่รักษาความลับของรหัสผ่านและรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของตน
LOOX สงวนสิทธิ์ระงับหรือยกเลิกบัญชีที่ละเมิดข้อกำหนดนี้โดยไม่ต้องแจ้งล่วงหน้า
สิทธิ์การใช้งานเนื้อหาที่สร้างขึ้น (License)
เมื่อชำระค่าบริการตามแพ็กเกจที่เลือกแล้ว ผู้ใช้จะได้รับสิทธิ์ใช้งานเนื้อหาที่สร้างขึ้นตามขอบเขตที่ระบุในแพ็กเกจนั้น เช่น:
- สิทธิ์ใช้งานส่วนบุคคล (Personal license) — ใช้เพื่อทดลองหรือใช้งานที่ไม่แสวงหากำไร
- สิทธิ์ใช้งานเชิงพาณิชย์ (Commercial license) — ใช้ในสื่อโฆษณา อีคอมเมิร์ซ หรือแคมเปญการตลาดตามขอบเขตที่ระบุ (เช่น จำนวนช่องทาง ระยะเวลา ภูมิภาค)
ข้อห้ามที่สำคัญ: ผู้ใช้ไม่มีสิทธิ์นำเนื้อหาที่สร้างขึ้นไปขายต่อในลักษณะชุดข้อมูล (dataset) เพื่อฝึกโมเดล AI อื่น ไม่มีสิทธิ์อ้างว่าเป็นภาพถ่ายของบุคคลจริง และไม่มีสิทธิ์นำไปใช้ในลักษณะที่ละเมิดข้อ 7 (ข้อห้ามการใช้งาน) ของข้อกำหนดนี้
LOOX ขอสงวนสิทธิ์ในทรัพย์สินทางปัญญาของโมเดล AI ฐานข้อมูล และเทคโนโลยีที่ใช้สร้างเนื้อหา ผู้ใช้ได้รับเพียงสิทธิ์ใช้งาน (license) ตามที่ระบุเท่านั้น มิใช่กรรมสิทธิ์ในทรัพย์สินทางปัญญา
การชำระเงินและการคืนเงิน
ราคาบริการเป็นไปตามที่ระบุในหน้าแพ็กเกจ ณ ขณะทำรายการ และอาจเปลี่ยนแปลงได้โดยจะแจ้งล่วงหน้า
บริการแบบสมัครสมาชิก (subscription) จะต่ออายุอัตโนมัติ เว้นแต่ผู้ใช้ยกเลิกก่อนรอบถัดไป
เครดิตหรือค่าบริการที่ชำระแล้วจะไม่คืนเงิน เว้นแต่กรณีที่กฎหมายกำหนดหรือเป็นความผิดพลาดของระบบ
ข้อห้ามการใช้งาน
ผู้ใช้ตกลงจะไม่ใช้บริการเพื่อสร้าง จัดเก็บ หรือเผยแพร่เนื้อหาดังต่อไปนี้โดยเด็ดขาด:
ภาพที่เกี่ยวข้องกับผู้เยาว์ในลักษณะทางเพศหรือไม่เหมาะสมไม่ว่ากรณีใด ๆ
ภาพลามกอนาจาร หรือเนื้อหาทางเพศที่ไม่ได้รับอนุญาต
ภาพที่แอบอ้าง เลียนแบบ หรือใช้ใบหน้า/อัตลักษณ์ของบุคคลที่มีตัวตนจริงโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษร
เนื้อหาที่หมิ่นประมาท ยั่วยุความรุนแรง เลือกปฏิบัติ หรือผิดกฎหมายในลักษณะอื่น
การใช้งานเพื่อหลอกลวง สร้างข้อมูลเท็จ หรือทำให้เข้าใจผิดว่าเป็นภาพถ่ายจริงโดยเจตนาปกปิด
LOOX มีสิทธิ์ตรวจสอบ ระงับ หรือลบเนื้อหาที่ต้องสงสัยว่าเข้าข่ายข้อห้ามข้างต้น และอาจดำเนินการทางกฎหมายหรือแจ้งหน่วยงานที่เกี่ยวข้องตามความเหมาะสม
การเปิดเผยว่าเป็นเนื้อหาที่สร้างจาก AI
ผู้ใช้ต้องปฏิบัติตามกฎหมายและข้อบังคับที่เกี่ยวข้องกับความโปร่งใสของเนื้อหา AI ในเขตอำนาจที่ตนเผยแพร่เนื้อหา (เช่น การติดป้ายกำกับว่าเป็นภาพที่สร้างด้วย AI) และรับผิดชอบต่อการปฏิบัติตามกฎหมายดังกล่าวด้วยตนเอง
ข้อจำกัดความรับผิด
บริการนี้ให้บริการตามสภาพที่เป็นอยู่ (“as is”) โดยไม่มีการรับประกันใด ๆ ทั้งโดยชัดแจ้งหรือโดยนัย LOOX ไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายที่เกิดขึ้นภายหลัง หรือการสูญเสียโอกาสทางธุรกิจอันเกิดจากการใช้บริการ ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต
การระงับและยกเลิกบัญชี
LOOX สงวนสิทธิ์ระงับหรือยกเลิกการให้บริการแก่ผู้ใช้ที่ฝ่าฝืนข้อกำหนดนี้ได้ทันที โดยไม่จำเป็นต้องคืนค่าบริการที่ชำระไปแล้ว
กฎหมายที่ใช้บังคับ
ข้อกำหนดฉบับนี้อยู่ภายใต้บังคับของกฎหมายไทย ข้อพิพาทใด ๆ ที่เกิดขึ้นให้อยู่ในเขตอำนาจศาลไทยเป็นหลัก เว้นแต่มีข้อตกลงเป็นอย่างอื่น
การแก้ไขข้อกำหนด
LOOX อาจปรับปรุงข้อกำหนดนี้เป็นครั้งคราว และจะแจ้งให้ผู้ใช้ทราบผ่านช่องทางที่เหมาะสมก่อนการเปลี่ยนแปลงมีผลบังคับใช้

Definitions
“Service” means the website and AI-powered tool for generating images of virtual fashion/product models, operated by LOOX.
“AI Model” means a human-like image generated by an artificial intelligence system, and is not a photograph of a real person unless expressly stated otherwise.
“User” means any individual or entity that registers for or accesses the Service.
“Generated Content” means any image, video, or output file produced through use of the Service.
Acceptance of Terms
By accessing or registering for the Service, you confirm that you have read, understood, and agree to be bound by these Terms and the accompanying Privacy Policy. If you do not agree, please do not use the Service.
You must be at least 20 years of age, or of legal age of majority under the laws of your country of residence, and have the legal capacity to enter into binding agreements.
Nature of the Service
The Service allows Users to generate images of virtual models using AI, for use in advertising materials, product imagery, or other marketing purposes. The resulting images are algorithmically generated works and are not photographs of real individuals, unless otherwise specified.
LOOX reserves the right to modify, update, or discontinue any feature of the Service at any time, with reasonable prior notice where practicable.
User Accounts
Users must provide accurate, truthful, and up-to-date information when registering.
Users are responsible for maintaining the confidentiality of their password and for all activity occurring under their account.
LOOX reserves the right to suspend or terminate any account that violates these Terms, without prior notice.
License to Generated Content
Upon payment for a selected package, Users receive a license to use the Generated Content within the scope specified for that package, including but not limited to:
Personal license — for trial or non-commercial use.
Commercial license — for use in advertising, e-commerce, or marketing campaigns, within the scope specified (e.g. number of channels, duration, region).
Important restrictions: Users may not resell Generated Content as a dataset for training other AI models, may not represent it as a photograph of a real person, and may not use it in any manner that violates Section 7 (Prohibited Uses) of these Terms.
LOOX retains all intellectual property rights in its AI models, databases, and underlying technology. Users are granted only a license to use the output as specified, not ownership of any intellectual property.
Payment and Refunds
Prices are as stated on the pricing page at the time of purchase and may change, with prior notice.
Subscription plans renew automatically unless cancelled before the next billing cycle.
Credits or fees already paid are non-refundable, except where required by law or in the case of a system error.
Prohibited Uses
Users agree that they will not use the Service to create, store, or distribute any of the following content under any circumstances:
Any content depicting minors in a sexual or otherwise inappropriate manner.
Pornographic material or unauthorized sexual content.
Content that impersonates, mimics, or uses the face/likeness of a real, identifiable person without their written consent.
Defamatory, violence-inciting, discriminatory, or otherwise unlawful content.
Use intended to deceive, spread misinformation, or misrepresent generated content as authentic photography with intent to conceal its origin.
LOOX reserves the right to review, suspend, or remove any content suspected of violating the above restrictions, and may pursue legal action or report to relevant authorities as appropriate.
AI Content Disclosure
Users are responsible for complying with any applicable laws or regulations regarding AI content transparency in the jurisdiction where they publish content (such as labeling content as AI-generated), and bear sole responsibility for such compliance.
Limitation of Liability
The Service is provided “as is” without any warranties, express or implied. LOOX shall not be liable for any indirect, consequential, or incidental damages, or loss of business opportunity, arising from use of the Service, to the fullest extent permitted by law.
Suspension and Termination
LOOX reserves the right to immediately suspend or terminate service to any User who violates these Terms, without any obligation to refund fees already paid.
Governing Law
These Terms are governed by the laws of Thailand. Any disputes arising hereunder shall be subject to the jurisdiction of the Thai courts, unless otherwise agreed.
Amendments
LOOX may update these Terms from time to time and will notify Users through appropriate channels prior to any changes taking effect.
